Understanding the T Visa

The T visa is a special nonimmigrant visa established to assist victims of severe forms of trafficking in persons. This visa serves dual purposes: it provides humanitarian relief to trafficking survivors while enabling law enforcement to combat human trafficking more effectively. T visa holders receive legal status in the United States for up to four years with work authorization and may access certain public benefits that support their recovery.

To qualify for a T visa, you must demonstrate four key requirements:

You must be or have been a victim of severe trafficking
Be physically present in the United States on account of trafficking
Have complied with reasonable requests for assistance in investigating or prosecuting trafficking (with exceptions for those under 18 or unable to cooperate due to trauma)
Establish that you would suffer extreme hardship if removed from the United States

What Qualifies as Human Trafficking?

Under U.S. law, human trafficking encompasses two main categories.

These are:

Sex trafficking, which occurs when a commercial sex act is induced by force, fraud, or coercion, or when the person performing the act is under 18 years old.
Labor trafficking, which involves recruiting, harboring, or obtaining a person for labor or services through force, fraud, or coercion for purposes of involuntary servitude, debt bondage, or slavery.

Trafficking can occur in various settings, including domestic work, agriculture, restaurants, construction, manufacturing, and commercial sex establishments. Traffickers commonly use physical violence, threats, psychological manipulation, document confiscation, or debt manipulation to maintain control.

The T Visa Application Process

The application process requires careful documentation of your trafficking experience. You begin by filing Form I-914 with USCIS along with supporting evidence of your victimization, physical presence in the United States due to trafficking, and cooperation with law enforcement when applicable.

Your evidence package may include:

Personal statements describing your trafficking experience
Medical records and psychological evaluations
Police reports or news articles
Affidavits from witnesses or support service providers
Documentation establishing extreme hardship

Unlike U visas, T visas do not require law enforcement certification, though statements from authorities can strengthen your application.

Including Family Members and Path to Permanent Residency

T visa holders may include certain family members in their application. If you are under 21, you may include your spouse, children, parents, and unmarried siblings under 18. If you are 21 or older, you may include your spouse and children. These derivative visas allow families to reunite safely with the same immigration benefits.

After three years in T nonimmigrant status, you may apply for lawful permanent residence if you demonstrate good moral character, have complied with reasonable requests for assistance, and would suffer extreme hardship upon removal. Obtaining a green card provides long-term stability and puts you on the path toward eventual U.S. citizenship.
