What Is a U Visa?

The U visa was created by Congress through the Victims of Trafficking and Violence Protection Act to strengthen law enforcement's ability to investigate and prosecute crimes while protecting victims who assist in those investigations. This visa recognizes that crime victims should not fear deportation when seeking justice or cooperating with authorities. U visa holders receive temporary legal status for up to four years and may apply for lawful permanent residence (a green card) after three years of continuous physical presence if they meet certain requirements.

To qualify for a U visa, you must meet all of the following criteria:

  • You were the victim of a qualifying criminal activity that violated U.S. law or occurred in the United States, its territories, or possessions
  • You suffered substantial physical or mental abuse as a result of the crime, which is evaluated based on factors including the nature of the injury, the severity of harm, and the duration of the abuse
  • You have credible and reliable information about the criminal activity that can assist authorities in investigating or prosecuting the crime
  • You were helpful, are being helpful, or are likely to be helpful to law enforcement or other government officials in the investigation or prosecution
  • The criminal activity violated U.S. law or occurred within U.S. jurisdiction
